Prehearsal Terms of Use and End User License Agreement

Prehearsal (the "App") is licensed to you by Prehearsal Studio (OPC) Private Limited, a company incorporated in India on September 9, 2026 (CIN U62010KA2026OPC227534), with its registered office at WeWork Princeville, Princeville Block, Embassy Golf Links Business Park, Challaghatta, Bengaluru, Karnataka 560071, India ("we", "us", "Licensor").

By downloading the App from the Apple App Store or Google Play Store, or by using the App in any other form we make available, you agree to this License Agreement. If you do not agree, do not use the App.

This License Agreement is between you and Licensor only, not with Apple Inc. or Google LLC. Licensor is solely responsible for the App and its content. Apple and Google have no obligation to provide maintenance or support for the App.

1. The App

Prehearsal helps you practice speaking for professional situations. You record a short rehearsal, and the App gives feedback on how you spoke and what came through. The feedback is generated automatically by software, including third-party artificial intelligence services. It is not professional coaching, medical, legal, or career advice, and it can be wrong. Use your own judgment before relying on it.

The App is not designed to meet industry-specific regulations such as HIPAA or FISMA. Do not use it for content that is subject to those rules.

2. Who can use the App

You must be at least 13 years old (or 16 where your local law requires). If you are under 18, you must have your parent's or guardian's permission. You may not use the App if you are barred from doing so under the laws of your country.

3. Accounts and free use

You can try the App without creating an account. During this anonymous trial we hold a temporary identity on your device so we can keep your sessions together. If you sign in later, your trial sessions are moved to your account. If you never sign in, trial data is deleted as described in our Privacy Policy.

Free use is limited (for example, by a lifetime number of practice minutes and a daily number of generated challenges). We may change these limits. Paid plans are described in section 14.

You are responsible for keeping your login secure. You may delete your account at any time from Settings inside the App.

4. License

We grant you a non-transferable, non-exclusive license to install and use the App on any device you own or control, in line with the App Store or Play Store usage rules. You may not share, sell, rent, lease, or sublicense the App. You may not copy, modify, reverse engineer, decompile, or create derivative works from the App, except where the law expressly allows it.

5. Your recordings and content

When you rehearse, the App captures your voice and, in video sessions, your camera. Your audio is streamed to a transcription service while you speak. Text transcripts and the analysis results are stored against your account. Raw audio and video are not stored on our servers; video stays on your device.

You own your recordings, transcripts, and the answers you give in your speaking profile ("Your Content"). You give us a limited license to store, process, and analyze Your Content so we can run the App, give you feedback, track your progress, and improve the App. We may use transcripts and analysis in de-identified form to improve our analysis quality.

Your analysis is private. No other user can see your recordings, transcripts, analysis, or speaking profile.

Scenarios are not. Practice scenarios (the situation, the prompt, and the hints) are generated by the App, sometimes from details you give us such as your industry or role. Scenarios do not contain your recordings or analysis. We may reuse a scenario for other users and may publish scenarios on our website. If you do not want a scenario reused, do not include personal or confidential details in the information you give us to generate it.

You are responsible for what you say in your rehearsals. Do not record content that is unlawful, that infringes someone else's rights, or that you are not allowed to disclose.

7. Technical requirements

The App needs a supported version of iOS or Android, a working microphone, and an internet connection. Check that your device meets the requirements shown on the App Store or Play Store listing. We may change the requirements with updates.

8. Maintenance and support

We are solely responsible for maintenance and support. Contact us at support@prehearsal.app. Apple and Google have no obligation to provide support.

9. Use of data

How we collect and use data is described in our Privacy Policy. We may collect technical information about your device and how you use the App to provide support, deliver updates, and improve the App.

10. Liability

We are not responsible for lost or inaccurate analysis, for decisions you make based on feedback from the App, for device incompatibility, or for problems caused by modifications you make to the App or your device. To the maximum extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in this agreement limits liability that cannot be limited by law, including mandatory consumer rights in your country.

11. Warranty

We warrant that the App is free of malware at the time of download and works substantially as described. Otherwise the App is provided "as is" without warranties of any kind. If the App fails to conform to this warranty, you may notify Apple or Google, who will refund the purchase price of the App (if any). Apple and Google have no other warranty obligation. Any other claims are between you and us.

12. Product claims and intellectual property

We, not Apple or Google, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App does not meet legal or regulatory requirements, and consumer protection claims. If a third party claims that the App infringes their intellectual property, we, not Apple or Google, are responsible for investigating, defending, settling, and discharging that claim.

13. Legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.

14. Subscriptions

Paid plans unlock more practice minutes and more feedback features. Plan names, limits, and prices are shown in the App before you buy.

Billing and renewal

Subscriptions are billed to your Apple ID or Google Play account and renew automatically at the end of each billing period unless you cancel at least 24 hours before it ends. Your account is charged for renewal within 24 hours before the current period ends.

Pricing

Prices may vary by region and currency as set by Apple or Google. We may change prices; changes are announced in advance and never apply to a billing period you have already paid for.

Free trials

If a subscription offers a free trial, it converts to a paid subscription at the end of the trial unless you cancel first. One free trial per user unless we say otherwise. The free plan (a limited number of practice minutes) is separate from any subscription trial and does not convert to a paid plan.

Cancellation and refunds

Manage or cancel your subscription in your App Store or Google Play account settings. We cannot cancel it for you. Refunds are handled by Apple or Google under their policies. To the extent the law allows, we do not offer additional refunds. If you live in the EU or UK, you have a statutory right to withdraw within 14 days unless you agreed to immediate delivery of digital content and acknowledged that you lose that right.

Changes to features

We may add, change, or remove subscription features, provided the change does not materially reduce the value of your subscription during the current billing period.

15. Termination

This license lasts until you or we end it. It ends automatically if you break any term of this agreement. When it ends, stop using the App and delete all copies. Sections 5, 10, 12, 16, and 17 survive termination.

16. Third-party beneficiaries

Apple and Google, and their subsidiaries, are third-party beneficiaries of this agreement. Once you accept it, they have the right to enforce it against you. You must comply with any third-party terms that apply when you use the App, such as your mobile carrier's data terms.

17. Governing law

This agreement is governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India. If you live outside India, this does not take away any mandatory consumer protection you have under the laws of your own country, and you may also bring a claim in your local courts where your law allows it.

18. Changes to this agreement

We may update this agreement. We will post the new version at prehearsal.app/eula.html and update the date at the top. For material changes we will notify you in the App or by email. Continuing to use the App after the change takes effect means you accept the new agreement.

19. General

If any part of this agreement is found invalid, the rest stays in effect and the invalid part is replaced by a valid term closest to its intent. This agreement, together with the Privacy Policy, is the entire agreement between you and us about the App.
